殖民法律与赖和文学创作

摘 要:1895乙未割臺,台湾被纳入日本殖民体制,海峡两岸中国人面临着各自的社会问题与主要矛盾。海峡两岸先觉者都走上救亡启蒙的道路,“民主”“科学”是祖国大陆五四新文化运动的主要内容与目标旨趣,“法律”则是日据台湾社会运动的斗争缘起与诉求方向。日据台湾,法律既是日本带来的现代化形式,也是异族殖民下的强权工具。赖和被尊为“台湾新文学之父”“台湾的鲁迅”,其新旧文学作品深具时代精神。考察赖和文本内外的法律因素,不难发现日据时期作为公平正义象征的“法律”极具殖民性特质。法律书写是赖和文学不同于祖国大陆现代作家作品的重要纬度,这是日据台湾特殊的殖民权力结构所决定,也是台湾文学对整个中华民族文学的丰富。

Colonial Law and Loa Hos Literary Creation
in a Legal Perspective

Abstract: In 1895 when Taiwan was ceded, it was incorporated into the colonial system of Japan when the Chinese people on both sides of the Taiwan Strait were faced with their own social issues and main problems and people with foresight took to the road of national salvation and enlightenment as democracy and science became the main contents and objective of the May Fourth New Culture Movement in mainland China and law became the origin of struggle and direction of appeal for the social movements in Japan-occupied Taiwan, where law was not only a modern form brought in by Japan but also a powerful tool under the colonialism by an alien race. Loa Ho, known as the Father of New Literature in Taiwan and Taiwans Lu Xun, has literary works, new and old, that are full of the times spirit. In examining the legal aspects in and out of Loa Hos texts, it is easy to find that the law that symbolized justice and fairness in the Japan-occupied period was qualified by its coloniality. Legal writing by Loa Ho is an important latitude that is different from the works of mainland Chinese writers, determined by the special colonial power structure in Japan-occupied Taiwan, and an enrichment of Chinese literature as a whole by Taiwanese literature.
