On the Construction of Environmental Administrative Public Interest Litigation System from the Perspective of Public Participation

Abstract:Environmental administrative public interest litigation is a special form of administrative litigation,but current legislature emphasizes the expansion of the procuratorate’s power in the development of environmental administrative public interest litigation,ignoring the role of public participation in the construction of the system,resulting in many difficulties such as the difficulty in responding to all lawsuits about ecological and environmental damage,and the damaged judicial credibility,etc.Therefore,China urgently needs to improve the environmental administrative public interest litigation system from the perspective of public participation,and for this purpose we need to expand the case sources by enriching the clue provision mechanism,to expand the subjects of environmental administrative public interest litigation who are mainly environmental protection groups,to form an adjudication mechanism with public participation,and to establish an information disclosure and exchange mechanism.These innovative and applicable measures will make China’s environmental administrative public interest litigation system open,cooperative and exchanged,diversify environmental governance,and improve the efficiency of the environmental administrative public interest litigation system.

On the Types of Party-government Joint Document and Its Regulations

Abstract:The joint document of the Party and government began in the early days of the People’s Republic of China,and it’s number has increased significantly since the deepening of reform.It has played a positive role in our country’s economic,political and social development,and its existence has a certain realistic basis.However,its normative attributes are not clear and corresponding regulations are lacking,which leads to its overuse and causes many difficulties to the rule of law.The Party-government joint document implements the Party’s leadership,and makes up for the lag of national laws and the coordination between intra-Party regulations and national laws.The classification of the Party-government document is a premise for the study of its attributes and regulations,which this paper discusses through typological analysis.To regulate the issuance of joint documents,this paper suggests establishing issuing prerequisite to prevent arbitrariness,strengthening the supervision before and after the issuance,and clarify their position in judicial practice and in the work of the Party and government.

On the Correction of Serious Misconducts in the Context of Procuratorial Legal Supervision

Abstract:In the classification and treatment of juvenile delinquency,correction of serious misconducts holds a central position.Research shows that different authorities have different criteria for grading and treating serious misconducts,and the assessment,decision-making,and management of correctional work are far from perfect.Prosecution is not meantioned in the related chapter in the “Law on Prevention of Juvenile Delinquency”,which,however,does not necessarily mean it is absent.On the one hand,based on a unified legal position,prosecutorial legal supervision should unify the criteria for the correction of serious misconducts.Serious misconducts should include not only juvenile offenses and public order offenses but also minor criminal offenses,and the complementary role of specialized correctional education should be clarified.On the other hand,prosecutorial authorities should give play to their integrated functions and strengthen external supervision of closed administrative systems.In handling juvenile cases they should simultaneously ensure protection and disciplinary measures,cooperate with specialized education committees to write social investigation reports,avoid administrative discretion in juvenile justice through administrative litigation and public interest litigation,and borrow criminal execution prosecutors’practices like “necessity reviews for correction” and on-site inspections.

On the Value Co-creation Mechanism in the Governance of Tobacco Counterfeiting and Smuggling under the Multiple Co-management Model: Based on the Cases of S City,G Province

Abstract:In the era of big data,cigarette counterfeiting and selling resorts to network,bringing more challenges to the governance of tobacco counterfeiting and smuggling,and tobacco counterfeiting and smuggling governance system needs to be upgraded.Based on the experience of Shanwei,this paper explores the building of value co-creation mechanism in tobacco monopoly.Through the use of data integration+grid management,and through multiple subjects’construction of a multi-dimensional co-management system,the tobacco monopoly ecosystem is created in Shanwei.Also a comprehensive governance based on the coordination,interoperability and information sharing between participants is established,realizing the value co-creation in the tobacco monopoly ecosystem.This paper clarifies the value co-creation mechanism in the governance of tobacco counterfeiting and smuggling,and provides reference for the upgrading of tobacco governance system in future.

The Dimension of Subjective Practice: Emotional Narratives and Popularization in Left-Wing Literature: On the Themes of Workers and Peasants Revolution in the 1930s

Abstract:The representation of reality and the mobilization of revolution were important propositions of the left-wing literary movement,Yan’an literature,and the Seventeen Years’literature.Howto overcome theoretical rigidity in selecting contemporary themes,to highlight new-era propositions in the internal transformation of literary creation,and to reflect the enormous potential of revolutionary realism were always the core issues of left-wing literature.In the 1930s,popularization became an inherent task of left-wing literature,and the reconstructive writing of the masses emphasized the writers’background as workers and peasants;on the other hand,as the object of left-wing writing,the masses were no longer loose and unorganized groups,but classes able to construct a nation state,and the subjectivity of the masses went into imaginative writing with historical inspiration and revolutionary calling.To re-understand the correlation between popularization of literature as the left-wing literary movement’s central task and its creative practice is greatly significant for the examination of the movement’s historical achievements and literary value.

On the Meaning of “Feng(风)” in the “Preface to Mao’s Book of Songs”

Abstract:The word “eng(风)” has a very ancient origin and it is one of the keys to the study of the “Preface to Mao’s Book of Songs”.However,its meaning is complicated and ambiguous,without a definite interpretation.Through the examination of its original meaning and its transmutation through concepts like “feng hua(风化)” and “feng ci(风刺)”,this study finds that its connotation changed from natural rhythm to witchcraft and sacrifice,and eventually to political indoctrination,as clarified in the period of social transformation when ceremony disintegrated.It entered “Liu Yi(六义)” with a a newand more appealing meaning,which enriched the poetic system and became the cornerstone for a poetic tradition which would influence future generations in the following centuries.

On Sukhomlinsky’s Nature Tour Curriculum and Its Enlightenment for Contemporary China

Abstract:That primary and secondary school students in our country spend most of the time in classroom reduces their interest in learning and affects their mental and physical development.Sukhomlinsky’s nature tour curriculum conforms to the nature of children and can help students to develop their language,thinking ability and health.By studying Sukhomlinsky’s thought of natural education,this paper expounds the connotations of nature tour curriculum,probes into its teaching place,method and content,and elicits its enlightenments for establishing nature tour curriculum in Chinese primary and middle schools: teaching students this curriculum in their early childhood,creating green classrooms in schools,arousing students’problem awareness,teaching mainly through dialogue,and returning to the essence of education,etc.

Symbolic Interaction: The Way for Children to Get Along with Others in Strange Situations

Abstract:Interaction is not only a way to promote children's physical and mental growth,but also a goal of their social development.Symbols are a dual carrier of information and meaning and the only approach behaviors and meanings can be expressed,and there are no meaningless symbols.According to the symbolic interactionism of Curry,Mead,and Bloomer,symbols(speech,images,words,actions,objects)are the foundation of human culture and the tools and means of social communication.Children understand the behaviors of others and engage in interactive communication through multimodal symbols.They also guess the impact of their own behaviors on others through symbols.Their behaviors all have social significance which will definitely be expressed through symbols.If teachers and parents understand semiotics,they can help children to get along with others,and to correctly handle their relationship with others and with the environment.

On the Application of Calligraphy Therapy Group Counseling in College Mental Health Education

Abstract:In order to explore the application of calligraphy therapy group counseling in college mental health education,we recruited 16 college students who voluntarily participated in calligraphy therapy group counseling for an empirical study,the result of which shows that calligraphy therapy group counseling can effectively alleviate college students’depression and anxiety.Accordingly,we put forward some suggestions for the application of calligraphy therapy group counseling in college mental health education,including a diversified teaching and research team to develop a structured curriculum,different forms of experiential teaching to cover more student groups,student clubs to form a support network of peer mutual assistance,and a focus on publicity and promotion to create a platform for display and exchange.

The Spread and Discipline of Psychological Ownership:A Study of Celebrity Fans’Group Behavior Formation Mechanism

Abstract:As super consumers willing to invest money,time and emotion,fans often show more enthusiasm than other consumers.Due t o the accessibility of stars in the real world,fans often have richer emotional needs and behavioral impulses,and their behavior motivations are more specific.This paper introduces the theory of psychological ownership into fan culture research to explore how fans' psychological ownership of celebrities affects their behavior and influences their group behaviors.Interviews with 22 fans show that fans’psychological ownership is collective,which develops through their group interaction and mutually influences their individual psychological ownership.Both individual and collective psychological ownership can trigger fans’impulse to display ownership relationship in social situations and profoundly affect their consumer behavior,civic behavior,and territorial behavior at the group level.

The Relationship between Affection Show on Social Network Sites and Onlookers’Subjective Well-being: An Adjusted Mediation Model

Abstract:This paper explores the relationship between affection show on social network sites(ASOSNS)and onlookers’subjective well-being(SWB),and examines the effects of loneliness and upward social comparison on SWB,with a questionnaire answered by 646 university students from Guangdong province.Correlation analyses show that passivity in accepting ASOSNS has a significant positive correlation with the onlookers’loneliness and a significant negative correlation with the onlookers’SWB.While loneliness itself presents a significant positive correlation with upward social comparison and a significant negative correlation with SWB.Passivity in accepting ASOSNS not only negatively predict the SWB of onlookers in a direct way,but also influence it through the mediating effect of loneliness.Upward social comparison plays an adjusting role in the first half-path of the mediation model.Compared to individuals with high levels of upward social comparison,the mediating effect is more significant for individuals with low levels of upward social comparison.In short,the effect of ASOSNS on onlookers’SWB is achieved through an adjusted mediation model.Affection show influences the onlookers’SWB through loneliness,and the upward social comparison adjusts the relationship between ASOSNS and loneliness.
