高校法学专业课程思政教育模式研究

摘 要:法学课程思政是加强高校法学专业大学生国家认同和自我认同的重要教育方式。法学课程思政正方兴未艾,教育模式需要进一步研究和完善。法学专业理论课程按照理论性和应用性标准,可划分为法学基础理论课程和应用型法学课程两大类型,思政内容融入其中,分别形成两大融合模式:重合模式和嵌入模式。法学课程思政还可以从国家、社会和个人三个层面进行融合。落实法学课程思政教育,可以采取直接講授法、阐释法和案例法等方法,各种方法可以灵活运用,相互结合。法学课程思政教育需要学校、教师和学生三方联动,契约模式是较好实现教育目标的途径。契约模式要求学生通过实践反思和认知反思,在生活实践中体悟课程思政内容。

Abstract: Ideological and political education in all courses of law major is an important way to strengthen the national recognition and self-identification of college students majoring in law. The thinking and administration of legal courses are in the ascendant, and the education mode needs to be further studied and improved. According to the theoretical and applied standards, the law professional theory courses can be divided into two types: basic law theory courses and applied law courses. The ideological and political content is integrated into them, respectively forming two integration modes: coincidence mode and embedding mode. The legal curriculum can also be integrated from the national, social and individual levels. To implement the ideological and political education in legal courses, the methods of direct teaching law, interpretation law and case law can be adopted, and various methods can be flexibly applied and combined with each other. The ideological and political education of the legal curriculum requires the tripartite linkage of schools, teachers and students, and the contract model is a better way to achieve the educational goals. The contract mode requires students to understand the ideological and political content of the course in life practice through practical reflection and cognitive reflection.

思政课程与课程思政是两个不同概念。思政课程是指特定的一门或一类关于思想政治教育的教育活动。而课程思政则是指在各类专业课程中融入思政教育元素,培养大学生成为践行社会主义核心价值观良好公民。
长期以来,高校思想政治教育存在“孤岛”困境,思政教育与专业教学“两张皮”的现象未能根本改变,归根到底是“全课程、全员育人理念”没有完全树立起来。除了单独的思想政治教育课程之外,还需要在专业课程中开辟新阵地,着力将思政内涵落实于专业课程教学之中。
“课程思政”的研究方兴未艾,相关资料有3000多份。课程思政原是以理工类课程为出发点建立起来的,而高校法学专业课程融入思政内容还处于起步阶段,在中国知网搜索“课程思政”和“法学”两个关键词,可搜索出相关论文90多篇。其中有文献综述的论文,如刚彦的《法学课程思政研究综述——以CNKI期刊数据库的相关文献为素材》[1];有整体研究法学课程思政教育的论文,如雷裕春的《法学本科专业课程思政教育体系构建研究》[2];还有专门法学类别的课程思政研究,如王畅、张慧的《卫生法学课程思政教学模式的策略建构》[3];其他论文多以法学部门法课程思政为研究对象,如倪明、王咏的《课程思政理念下<经济法>教学改革研究》等等[4],不一而足。本文主要从整体上讨论法学课程思政教育模式,包括为什么要在法学课程中融入思政内容、如何融入以及如何落实等方面。
