On the Collective Intention and the Problems of Its Regression

Ji Shiqiang and Chen Xiaoping 42

By tracing some various ways to study collective intention, we find that controversy usually come from the confusion between the nature and the possessors of collective intention. Therefore, we divide collective intention into intention of collectivity and the collective possession of intention, and then make a distinction between the internal collectivity and the external collectivity. Our conclusion is that it is impossible to reduce the intention of collectivity to individual intention and to reduce the internal collectivity to external collectivity. However, only from the physiological or physical viewpoint, can we reduce the internal collectivity to external collectivity, and then to the individuals.

Wang Hejian 51

The global financial crisis actually declared the end of the mainstream mode of economic globalization and also its transformation. Great changes of international economic order has a significant impact on Chinese economy. Be limited by its global production-based mode of economic growth, China has been confronted with double obstacles, that is the reduced demand from the external market and meanwhile the rising cost of internal production. In this case, the changes of domestic and international conditions determine China’s economic growth mode to do some kind of adaptive conversion, which may rebuild a consumer-driven economic growth. Therefore, we should have a deeper understanding of the fundamental problem at cognitive level, namely how the consumption promotes economic growth. Different from the mainstream economics, the core research strategies and methods of economic sociology are carried on at the level of action and organization, and treat the interaction between consumers and producers as the major content, so that it can provide a powerful insight into how consumption can produce an effect on the economic transition and economic growth by converting the method of productive organization.

A Discrimination of the Pledge Right of Intellectual Property

Qiu Zhiqiao 72

There are different theories about the nature of the pledge right of intellectual property, and each of them can't solve the problem of theoretical interpretation, and cannot eliminate the practical dilemmas in the intellectual property rights and pledge financing. After a thorough analysis and discussions in the thesis, viewpoints are drawn as the follows: the pledge right of intellectual property is a technical civil right, rather than a separate substantive civil right. It is neither a real right, nor a debt right. It is the right to pledge or guarantee the debt, and it is regulated by law, especially in the effectiveness of priority of the debt. The paper suggests that the legal regulation of the pledge right of intellectual property in China be improved and adjusted in accordance with the above ideas.
