Abstract:The requirement of “theoretical realization” of Marxism makes it necessary to develop historical materialism and the connotation of the “new era” makes the development of historical materialism inevitable, which constitute the logical premise for the development of historical materialism in Xi Jinping Thought on Socialism with Chinese Characteristics for a New Era. On this basis, Xi Jinping Thought on Socialism with Chinese Characteristics for a New Era has creatively transformed historical materialism into theoretical guidance that meets the needs of contemporary China’s social development, by solving the tasks of the times, strengthening theoretical armed forces, criticizing erroneous trends of thought, and constructing the grand view of history, and practically opened up a new realm of historical materialism development in the two-way interaction between practice and theory. The clarification and revelation of logical premise and logic can better understand the necessity, inevitability and self-consciousness of this thought in theoretical innovation.

Abstract:The construction of diversified resolution system of administrative disputes is an important reform measure to adhere to “putting the non-litigation dispute settlement mechanism ahead” and promote the governance of litigation sources of administrative disputes. As a participant in the prevention of the source of administrative disputes, the people’s court can help the administrative organs improve their administrative ability in accordance with the law from the aspects of rules, decision-making and law enforcement, and expand the judicial governance function of administrative trials from the improvement of internal risk prevention mechanism and the integration of administrative trials and legal publicity. As the guider of the front-end resolution of administrative disputes, the people’s court can start from the procedural guidance of pre-litigation diversion and the guidance and coordination of front-end resolution to promote the better play of the role of non-litigation resolution and correction force. As the litigation and non-litigation connecting regulator of administrative disputes, the people’s court can make concerted effort from the procedural norms of pre-litigation mediation and the guidance of litigation cases to form a pattern of administrative dispute resolution by multiple subjects. The correct orientation of the people’s court in the diversified resolution system of administrative disputes can further expand the development space of the administrative trial system and contribute more judicial power to the comprehensive construction of a government ruled by law.

Abstract:Due to the global pandemic of COVID-19, and the tremendous international geo-political changes, plus anti-globalization developments, the current environment of Chinese investment into other countries turns much more complicated than before and the Belt and Road investment risk has been increasing sharply. Therefore, this paper discusses the Belt and Road investment risk and risk prevention into the 149 Belt and Road countries (BRCs). This paper firstly builds up a risk analytical framework which consists of five dimensions and 25 indicators, then calculating and evaluating the country risks of the Belt and Road investments (mostly by Chinese companies) into the 149 BRCs based a Two-layer Assessment Model; secondly, the paper continually analyzes the Belt and Road investment risks into different countries based on “investment-risk” Four-quadrant Analytical Method; finally, the paper proposes some strategies for Belt and Road investment prevention based on the analysis, in order to support high quality as well as long term sustainable development of the Belt and Road.

Abstract:The concepts in ancient Chinese aesthetics have three aspects,including the terms(the general concepts),the categories(the core concepts)and the propositions (the concepts presented by phrases and short sentences). The aesthetic terms make their progress on the foundation of philosophical terms,combining the practice of literature and art;some of them are summaries and expressions of the art practice, showing the characteristics of openness. Some aesthetic terms use figurative language to express their original meaning,therefore achieving the goal of expressing their extended meaning. On the basis of the underlying logical system of Chinese philosophy,the aesthetic categories are also abstracted from the art practice, linking the two during the integration process. As an extension of the aesthetic terms and categories,the aesthetic propositions make some judgments,expressing the aestheticians’ opinions. With the categories and propositions as its muscles and bones, the thought of Chinese ancient aesthetics takes the underlying logic system as its Jing, and the terms, categories and propositions in various literary thoughts as its Wei, embodying its system of knowledge.
